BDL/TDL is engaged in the business of providing on a subscription basis to its members, access to telehealth and/or telemedicine consultations provided by physicians who are independently contracted with BDL/TDL to participate in BDL/TDL’s proprietary network of participating physicians (“Network Physicians”), as well as to the proprietary technology and non-medical operational and administrative services provided by BDL/TDL that are attendant thereto (the “BDL/TDL Services”);
II. INFORMATION THAT MAY BE COLLECTED
In order to use the Services, you are asked to enter an e-mail address and password, which we refer to as your BDL/TDL ID or credentials. After you create your ID, you can use the same credentials to log in to BDL/TDL’s website and utilize the Services. This log in process will allow you to manage your account and allow you to schedule consultations.
The first time you log in to BDL/TDL’s website to utilize the Services, you will be asked to create an account also known as your profile. To create an account, you must provide personal information such as name, address, telephone number, date of birth, e-mail address, gender, and other pertinent data that will be available for you to share with a Network Physician. BDL/TDL will use the e-mail address you provide when you create your account to send you an e-mail requesting that you validate your account. Your e-mail address may also be used by BDL/TDL to provide appointment reminders, changes in appointments, and messages from Network Physicians. BDL/TDL will use your e-mail address as the primary means to reset your username and password. Your e-mail address will not be shared with any other third parties and will not be used for advertising or sales purposes.
BDL/TDL creates a record of the care and services you receive from Network Physicians. Some examples of the information collected or created through this process are video and/or audio files associated with all consultations, electronic medical records that may be uploaded or created as a result of treatment, and medical test results. When applicable, we will collect credit card or billing/payment account information which we maintain in encrypted form on secure servers. In order to participate in the services provided by the Network Physicians, you will need to provide Personal Health Information about yourself to BDL/TDL on behalf of the Network Physicians. Here are examples of the types of Personal Health Information we gather:
III. HOW INFORMATION ABOUT YOU MAY BE USED BY BDL/TDL
BDL/TDL may gather PHI primarily to share with the Network Physicians for the purposes of diagnosis, treatment, and health care operations. However, in limited circumstances BDL/TDL may use de-identified, non-personal information for statistical analysis, improvement of services, and customization of web design and content layout.
Uses and Disclosures of PHI
BDL/TDL is permitted to use and disclose your PHI for purposes of (i) Treatment, (ii) Payment, and (iii) Health Care Operations as follows:
For Treatment. BDL/TDL may use or disclose your PHI to facilitate treatment or the provision of health care services to the Network Physicians for purposes of a consultation or in connection with the provision of follow-up treatment. BDL/TDL may share your PHI with doctors, nurses, technicians, or other BDL/TDL workers. This may include prescriptions, lab work, and x-rays. BDL/TDL may share your PHI with people not at BDL/TDL including, but not limited to, referring physicians and home health care nurses who are treating you or providing follow-up care.
For Payment. BDL/TDL may use and disclose your PHI with others who help pay for your care such as health insurers or health plans in connection with the processing and payments of claims and other charges.
For Health Care Operations. BDL/TDL may use and disclose your PHI in connection with the health care operations of the Network Physicians. These uses and disclosures help us assist in Network Physician programs and assure patients receive quality care. For example, BDL/TDL may use PHI to measure the performance of its staff and how they and the Network Physicians care for you. BDL/TDL may share PHI with third parties who BDL/TDL engages to provide various services for BDL/TDL and you such as doctors, nurses, technicians, and other health care workers. If any such third party requires access to your PHI in order to perform the agreed upon services, BDL/TDL will require that third party be bound to the terms outlined in this Privacy Notice.
Business Associates. BDL/TDL may contract with outside businesses to provide some services. For example, BDL/TDL may use the services of imaging, laboratories or collection agencies. Each contracted party must enter into a HIPAA Business Associate agreement with BDL/TDL, which requires said third party businesses to protect PHI that is shared with them in accordance with the restrictions outlined in this Privacy Notice. Furthermore, PHI will only be provided to third party businesses for the limited scope of performing required services to help facilitate treatment, payment, and health care operations to you.
For Appointment Reminders. BDL/TDL may contact you to remind you about your appointment for medical care.
Treatment Alternatives. BDL/TDL may use and disclose PHI to tell you about different types of treatment available to you. BDL/TDL may use and share PHI to tell you about other benefits and services related to your health.
Authorization. BDL/TDL is permitted to use and disclose your PHI upon your written authorization, submitted on our form which will be provided to you upon request, to the extent that such use or disclosure is consistent with your authorization. Your written authorization is required for the release of any mental health notes, marketing to you of any products or services not related to you care or treatment, or the sale of any information that is not de-identified. Please note that you may revoke or limit any such authorization at any time. BDL/TDL cannot take back any disclosures we have already made with your permission. BDL/TDL is required to keep records of the care that we provided to you. Be assured that any uses or disclosures not described in this notice will require your written authorization.
People Involved In Your Care. With your permission, BDL/TDL may share your PHI with a family member or friend who helps with your medical care. We may share your PHI with a group helping with disaster relief efforts. We do this so your family can be told about your location and condition. If you are not present or able to say no, we may use our judgment to decide if sharing your PHI is in your best interest.
Research. In support of telehealth, telemedicine and/or ehealth initiatives, BDL/TDL may use and disclose your PHI for research. BDL/TDL will only use and disclose information for research if BDL/TDL receives your written consent, or if a review committee that meets Federal standards says BDL/TDL does not need your consent.
Genetic Information. Without your written authorization, BDL/TDL does not collect or use genetic information, nor does BDL/TDL use genetic information for underwriting and related purposes.
Fundraising Activities. BDL/TDL will not disclose your individual PHI for fundraising activities without your written authorization.
As Required By Law. BDL/TDL may use and disclose your PHI when required to do so by federal, state or local law.
To Prevent A Serious Threat To Health Or Safety. BDL/TDL may use and disclose your PHI to prevent a serious threat to your health and safety and that of others. BDL/TDL will only disclose your PHI with persons who can help prevent the threat.
Testimonials. We display personal testimonials of satisfied customers on our site in addition to other endorsements. With your written authorization we may post your testimonial along with your name.
How BDL/TDL May Use and Disclose PHI – Special Situations Military. If you are in the U.S. or foreign armed services, BDL/TDL may share your PHI as required by the proper military authorities.
Workers’ Compensation. BDL/TDL may share your PHI for workers’ compensation or programs like it. BDL/TDL may do this to the extent required by law.
Public Health Risks. BDL/TDL may share your PHI for public health activities, as required by federal, state or local law.
For example, we may share your PHI:
De-identified Information. BDL/TDL may use, disclose, and request PHI if the Health Information to be used or disclosed is de-identified pursuant to the procedures set forth in 45 CFR 145.514(a)-(c).
Health Oversight Activities and Registries. BDL/TDL may share your PHI with government agencies that oversee health care. BDL/TDL may do so for activities approved by law. These activities include, but are not limited to, audits, investigations, inspections and licensure surveys. The government uses these activities to monitor the health care system. It also monitors the outbreak of disease, government programs, compliance with civil rights laws, and patient outcomes. BDL/TDL may share PHI with government registries, if required.
Lawsuits and Disputes. If you are in a lawsuit or a dispute, BDL/TDL may share your PHI in response to a court order, legal demand or other lawful process.
Law Enforcement. BDL/TDL may share PHI if asked to do so by a law enforcement official under limited circumstances as follows:
Decedents. BDL/TDL may, under limited circumstances, disclose your PHI to coroners, medical examiners, funeral directors for the purposes of identification, determining the cause of death and fulfilling duties relating to decedents.
National Security. BDL/TDL may share, if required, your PHI with the proper federal officials for national security reasons.
IV. HOW SECURITY IS HANDLED AT BDL/TDL
The importance of security for all personal information including, but not limited to, PHI associated with you is of utmost concern to us. At BDL/TDL, we exercise state of the art care in providing secure transmission of your information from your PC or mobile device to our servers. PHI collected by our web site is stored in secure operation environments that are not available or accessible to the public. Only those who need access to your information in order to do their jobs are allowed access, each having signed confidentiality agreements. Any employee who violates our privacy or security policies is subject to disciplinary action, including possible termination and civil and/or criminal prosecution. BDL/TDL is not only HIPAA compliant, but additionally utilizes the latest technologies to ensure utmost security. BDL/TDL uses several layers of firewall security and different degrees of encryption for each customer’s sensitive PHI to ensure the highest level of security which meets or exceeds the requirements promulgated under HIPAA (defined below) BDL/TDL will not sell or lease the information collected on this site to others. BDL/TDL does not sell or lease any customer lists, e-mail addresses, cookies or other data without your written authorization.
Secure interaction. When you interact on our web site, all of your PHI including, but not limited to, your credit card number and delivery address, is transmitted through the Internet using Secure Socket Layers (SSL) technology. SSL technology causes your browser to encrypt your entered information before transmitting it to our secure server. SSL technology, an industry standard, is designed to prevent someone other than operators of our web site from capturing and viewing your personal information. BDL/TDL also takes the following measures to protect your PHI online:
Passwords. To provide you with an increased level of security, online access to your PHI is protected with a password you select. We strongly recommend that you do not disclose your password to anyone. BDL/TDL will never ask you for your password in any unsolicited communication (including unsolicited correspondence such as letters, phone calls, or E-mail messages).
Information. Since any entered information you provide to us on our website will be transmitted using a secure connection, if your web browser cannot support this level of security, you will not be able to order products through our website. The most recent versions of Safari, Netscape Navigator, Microsoft Internet Explorer and Firefox can support a secure connection and can be downloaded for free from their respective websites.
No data transmission over the Internet can be guaranteed to be 100% secure. While we strive to protect your PHI from unauthorized access, use or disclosure, BDL/TDL cannot ensure or warrant the security of any information you transmit to us on our web site.
V. Privacy Rights
We are required by law to make sure that PHI that identifies you is kept private, give you this Notice of our legal duties and privacy practices concerning your PHI, and follow the terms of this Notice currently in effect.
You have the following rights regarding the PHI that BDL/TDL maintains about you:
Right To Inspect and To Receive Copies. You have the right to view and receive copies of the PHI used to make decisions about your care, provided you submit your request in writing. Usually, this includes medical and billing records. It does not include some records such as mental health notes. BDL/TDL may deny your request to view and/or copy your PHI in limited circumstances. If your request is denied, BDL/TDL will inform you of the reason of the denial and you have the right to request a review of the denial. Right To Amend. If you think that personal information BDL/TDL has about you is wrong or incomplete, you have the right to ask for an amendment to your record. To request deletion of any personal information or ask for a change to your record, you must make your request in writing on the approved form. The form will be provided to you upon request. If we are not able to comply with your request, we will respond with an explanation. BDL/TDL may, under the following limited circumstances, deny your request for an amendment to your record.
BDL/TDL may Deny your request if it is not submitted in writing or does not include a reason to support the request. BDL/TDL may also deny your request if you ask BDL/TDL to amend information that:
We will retain your information for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
Right To an Accounting of Disclosures. You have the right to get a list of the disclosures BDL/TDL has made of your PHI. This list will not include all disclosures that BDL/TDL made. For example, this list will not include disclosures that BDL/TDL made for treatment, payment or health care operations. It will not include disclosures you specifically approved. To ask for this list, you must submit your request in writing on the approved form. The form will be provided to you upon request.
Right To Request Restrictions. You have the right to ask for a restriction or limitation on the PHI that BDL/TDL uses or discloses for treatment, payment or health care operations. You also have the right to ask for a limit on the PHI that BDL/TDL discloses with someone who is involved in your care or in the payment for your care. Such a person may be a family member or friend. BDL/TDL is not required to comply with your request. If BDL/TDL does agree, we will fulfill your request unless the information is needed to provide you with emergency treatment or if otherwise required by law. To ask for restrictions, you must make your request in writing on a form that we will give you upon request. You must tell us:
Right To Request Confidential Communications. You have the right to request confidential communications of your PHI or medical matters. You may request that BDL/TDL communicate with you through specific means or at a specific location. You must make your request in writing on a form that will be provided to you upon request. BDL/TDL will fulfill all reasonable requests.
Right To a Paper Copy of This Notice. You may ask BDL/TDL to give you a written copy of this Notice at any time. Even if you have agreed to get this Notice electronically, you still have a right to a paper copy of this Notice.
VI. Revisions To This Notice
BDL/TDL is constantly innovating and implementing new features as part of its services. As a result, our privacy practices may change. We may revise this Notice to reflect any changes in our privacy practices. We reserve the right to make the revised Notice effective for PHI we already have about you. It also will be effective for any information we receive in the future. We will post a current version of the Notice on this Site prior to the change becoming effective. If we make any material changes we will notify you by email (sent to the e-mail address specified in your account) or by means of a Notice posted on this Site prior to the change becoming effective.

Medical Information: The member is responsible for providing accurate and up-to-date medical information to Best Docs Live when calling for a physician consultation when any information changes. If a member provides any information related to AIDS or HIV, including testing for the presence of the HIV + anti-body/antigen, results of such test, and/or diagnosis of AIDS and related conditions, the member will be required to provide written authorization to release this information.
Transmission of Medical Information: A member’s information may be mailed, faxed or released over the telephone when authorized, along with any documents the member has supplied to Best Docs Live. A member’s medical information will be released only to qualified medical personnel for the purpose of the member’s care or for any other member-authorized situation.
Service Interruption: A member’s service may be interrupted if they do not remain a member in good standing. A member in good standing has: (a) verified their medical information as current, (b) paid their membership fee and not gone into arrears, (c) has not provided Best Docs Live with a written notice of cancellation. A member’s authorization to release medical information will be valid for the lifetime of their membership until they provide Best Docs Live with a notice of cancellation or until a member is no longer in good standing. A member may not hold Best Docs Live responsible for acting in reasonable reliance upon their authorization prior to the time that Best Docs Live learns of the member’s cancellation or amendment. All services are not available in all states.
General Release: You are entering into a doctor/patient relationship with Best Docs Live. You acknowledge that you already have a primary care physician and Best Docs Live is not a substitute to your primary care physician. You agree to designate Best Docs Live as your provider when your primary care physician is not available. Best Docs Live is obligated to use commercially reasonable efforts to ensure that the member’s medical information accurately reflects the information provided by the member. Best Docs Live is not responsible for, and disclaims all liability for, any and all damages arising due to any errors, inaccuracies or omissions in the application due to errors, inaccuracies, or omissions in the information provided to Best Docs Live by the member. Best Docs Live shall have no liability whatsoever for any indirect, consequential, exemplary, special, incidental or punitive damages. Best Docs Live’s liability to the member for any reason and upon any cause of action, whether tort, contract, statute or any other legal theory whatsoever, shall be at all times and in the aggregate limited to the lesser of (a) $1,000.00, or (b) the amount of compensation actually paid by the member or client to the company during the three (3) months period immediately preceding the month in which the event upon which the liability is predicated.
Confidentiality: Best Docs Live will release any and all information only as authorized for disclosure by the member and as permitted by law. Each request for information will be verified before any disclosure will be made. Best Docs Live will make every attempt to confirm that the requested information is received by the intended recipient. All memberships are maintained at the highest level of confidentiality and are never provided to other services. Use of information provided by Best Docs Live cannot guarantee that information provided to recipients will be used or acknowledge.
Recurring Billing: By starting your Best Docs Live membership and providing or designating a Payment Method, you authorize us to charge you a monthly membership fee at the then current rate, and any other charges you may incur in connection with your use of the Best Docs Live service including doctor consultations, to your Payment Method. You acknowledge that the amount billed each month may vary from month to month for reasons that may include differing amounts due to number of consults, promotional code redemptions, and/or changing or adding a plan, and you authorize us to charge your Payment Method for such varying amounts, which may be billed monthly in one or more charges.
No Refunds: PAYMENTS ARE NONREFUNDABLE AND THERE ARE NO REFUNDS OR CREDITS FOR PARTIALLY USED PERIODS. Following any cancellation, however, you will continue to have access to the service through the end of your current billing period. At any time, and for any reason, we may provide a refund, discount, or other consideration to some or all of our members (“credits”). The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future, under any circumstance.
Payment Methods: You may edit your Payment Method information by visiting our website and clicking on the “Your Profile” link, available at the top of the page once logged into the Best Docs Live website. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not edit your Payment Method information or cancel your account (see, “Cancellation” below), you remain responsible for any uncollected amounts and authorize us to continue billing the Payment Method, as it may be updated. This may result in a change to your payment billing dates. For certain Payment Methods, the issuer of your Payment Method may charge you a foreign transaction fee or other charges. Check with your Payment Method service provider for details.
Cancellation: You may cancel your Best Docs Live membership at any time, and you will continue to have access to the Best Docs Live service through the end of your monthly billing period. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL-MONTH MEMBERSHIP PERIODS OR UNWATCHED BEST DOCS LIVE CONTENT. To cancel, go to the “My Profile and then My Payments” page on our website and simply click on the cancel account link next to your payment information. If you cancel your membership, your account will automatically close at the end of your current billing period. To see when your account will close, click “View billing details” on the ” My Profile page. If you signed up for Best Docs Live using your account with a third party as a Payment Method, and wish to cancel your Best Docs Live membership at any time, you may need to do so through such third party, including by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from, the Best Docs Live service through that third party. You may also find billing information about your Best Docs Live membership by visiting your account with the applicable third party.

Informed Consent for Services Provided by BDL/TDL Network Physicians
By requesting a telehealth and/or telemedicine consultation, you are requesting to enter into a doctor/patient relationship with a physician who is independently contracted with Best Docs Live Inc.(“BDL”), Truckers Docs Live LLC.(“TDL”) to participate as a Network Physician. The consulting Network Physician shall be the actual provider of the professional medical services to you. While BDL/TDL provides certain technology and administrative services to you and the Network Physicians, BDL/TDL does not itself provide the professional medical services to you. Therefore, you agree to pay BDL/TDL on behalf of the Network Physician for the telehealth and/or telemedicine consultations at the time they are requested, unless payment arrangements have been established through your employer, association, or other entity.
As a requirement of the Network Physicians, you agree to complete a medical history form that BDL/TDL will store electronically and make available to each Network Physician who performs a telehealth and/or telemedicine consultation for you.
You acknowledge that, if you have a primary care physician, that relationship is not replaced by a Network Physician. Furthermore, you agree that, by requesting a telehealth and/or telemedicine consultation from a Network Physician, you are designating the Network Physician as your physician because your primary care (or other) physician, as applicable, is not available.
You acknowledge that Network Physicians will not prescribe any Drug Enforcement Agency controlled substances nor do they guarantee that a prescription will be issued. There is further no guarantee that you will be treated as a patient by a Network Physician if, for example, a Network Physician determines that your medical condition cannot be properly treated by him/her.
If you are treated by a Network Physician, you have a right to your medical records in accordance with applicable law.
The telehealth and/or telemedicine services provided by the Network Physicians (and the technology and non-medical operational and administrative services provided by BDL/TDL that are attendant thereto) may involve the use of electronic communications to enable the Network Physicians at distant locations to access your patient medical information for the purpose of providing you patient care. The information may be used for diagnosis, treatment, follow-up and/or education, and may include any of the following:
Electronic systems used will incorporate network and software security protocols to protect the confidentiality of patient identification and imaging data and will include measures to safeguard the data and to ensure its integrity against intentional or unintentional corruption.
